EZ PARTY RENTALS

TERMS OF SERVICE

Welcome to EZ Party Rentals, By booking, renting, or using any equipment or services provided by EZ Party Rentals, you (“Client,” “Customer,” or “you”) agree to the following Terms of Service.

These Terms apply to all party and event rental services, including but not limited to tables, chairs, linens, décor, photo booths, concession machines, inflatables, entertainment equipment, special-event equipment, and other rental products offered by EZ Party Rentals.

1. BOOKING & RESERVATION

A rental reservation is considered confirmed only after:

1. The requested rental items and event details have been agreed upon;

2. The required deposit or booking payment has been received; and

3. The Client has accepted or signed the applicable rental agreement/contract.

Submitting a rental inquiry or quote does not guarantee availability or reserve equipment.

EZ Party Rentals reserves the right to decline or cancel a reservation when necessary due to equipment availability, safety concerns, logistical limitations, or other circumstances beyond our reasonable control.

2. DEPOSITS & NON-REFUNDABLE PAYMENTS

All deposits are NON-REFUNDABLE.

The deposit is required to secure and reserve the requested equipment and event date. Once a reservation is confirmed and the deposit has been received, EZ Party Rentals may decline other customers for the same date and allocate resources toward fulfilling the Client's reservation.

Because of this, deposits will not be refunded due to cancellation, change of plans, failure to attend an event, venue issues, or other circumstances initiated by the Client, except where otherwise required by applicable law.

A deposit may be applied toward the Client's remaining balance according to the terms of the individual rental agreement.

Any payment identified as a deposit, retainer, reservation fee, or booking fee will be treated as non-refundable unless applicable law requires otherwise.

3. CANCELLATIONS

All cancellations must be submitted to EZ Party Rentals in writing.

Cancellation of a reservation does not automatically entitle the Client to a refund of the deposit.

If the Client cancels an event after booking, EZ Party Rentals may retain the deposit and any other non-refundable amounts specified in the rental agreement.

Depending on the timing of the cancellation, additional charges may apply if EZ Party Rentals has already incurred costs related to staffing, preparation, customization, delivery, setup, or other services.

4. RESCHEDULING

Requests to change an event date are subject to availability and must be approved by EZ Party Rentals.

A rescheduling request does not guarantee that the original deposit or payment will be transferred to the new date.

If EZ Party Rentals approves a date change, additional fees may apply depending on the circumstances and availability of equipment.

A date change that cannot be accommodated may be treated as a cancellation.

5. FINAL PAYMENT

The remaining balance must be paid according to the payment schedule stated in the Client's rental agreement or invoice.

Failure to make the required payment by the stated deadline may result in cancellation of the reservation and forfeiture of the deposit.

EZ Party Rentals reserves the right to withhold delivery, setup, or use of rental equipment until the required balance has been paid.

6. RENTAL PERIOD

The rental period begins and ends at the times specified in the rental agreement.

The Client is responsible for ensuring that the rental location is accessible and ready at the scheduled delivery, setup, pickup, or return time.

Additional charges may apply for:

• Extended rental periods;

• Late returns;

• Delayed pickup;

• Additional setup or breakdown time;

• Waiting time caused by the Client or venue;

• Unauthorized use beyond the agreed rental period.

7. DELIVERY & SETUP

Delivery and setup services are subject to the terms stated in the Client's invoice or rental agreement.

The Client is responsible for providing accurate delivery information and ensuring that EZ Party Rentals has reasonable access to the event location.

The Client must notify EZ Party Rentals of:

• Stairs;

• Elevators;

• Long walks from vehicle access to setup location;

• Restricted entrances;

• Parking limitations;

• Loading dock requirements;

• Venue restrictions;

• Other conditions that may affect delivery or setup.

Additional fees may apply when conditions require additional labor, equipment, travel, or time.

EZ Party Rentals is not responsible for delays caused by inaccurate information, inaccessible locations, traffic, venue restrictions, weather, or circumstances beyond our reasonable control.

8. CLIENT RESPONSIBILITY FOR RENTAL EQUIPMENT

The Client is responsible for all rental equipment from the time of delivery or pickup until the equipment is returned to EZ Party Rentals or collected by EZ Party Rentals.

The Client agrees to:

• Use equipment only for its intended purpose;

• Follow all instructions provided by EZ Party Rentals;

• Keep equipment in a safe and secure location;

• Prevent unauthorized use;

• Prevent theft, loss, misuse, or damage;

• Keep equipment away from hazardous conditions;

• Notify EZ Party Rentals immediately if equipment is damaged, lost, or malfunctioning.

The Client may be financially responsible for repair or replacement costs resulting from damage, loss, theft, misuse, neglect, or unauthorized use.

9. DAMAGE, LOSS & REPLACEMENT

The Client is responsible for rental equipment while it is in their possession or under their control.

If equipment is damaged, lost, stolen, destroyed, or returned in a condition requiring repairs beyond normal wear and tear, the Client may be charged for:

• Repair costs;

• Replacement costs;

• Cleaning or restoration costs;

• Missing parts or accessories;

• Transportation costs;

• Labor associated with repair or replacement.

Replacement charges may be based on the current cost of obtaining a comparable replacement item.

10. CLEANING

Rental equipment must be returned in reasonably clean condition.

Excessive dirt, food, grease, wax, mud, stains, spills, confetti, glitter, or other substances may result in additional cleaning charges.

The Client may not intentionally expose rental equipment to conditions that are likely to cause damage or excessive cleaning requirements.

11. WEATHER POLICY

Outdoor rentals are subject to weather and safety conditions.

EZ Party Rentals reserves the right to delay, modify, suspend, or cancel delivery, setup, or use of equipment when weather conditions create an unsafe environment for our employees, contractors, equipment, or guests.

Examples may include severe storms, high winds, lightning, flooding, extreme temperatures, or other hazardous conditions.

Weather-related cancellations or changes will be handled according to the Client's individual rental agreement and applicable company policy.

The deposit remains non-refundable unless otherwise required by applicable law or expressly stated in writing by EZ Party Rentals.

12. SAFETY

EZ Party Rentals reserves the right to refuse delivery, setup, or operation of equipment if conditions are deemed unsafe.

The Client agrees not to move, modify, disassemble, repair, alter, or tamper with rental equipment unless expressly authorized by EZ Party Rentals.

EZ Party Rentals may immediately remove equipment from an event if it is being used in an unsafe, unauthorized, or improper manner.

13. VENUE REQUIREMENTS

The Client is responsible for obtaining any required permission or approval from the event venue, property owner, municipality, or other authority for the use of rental equipment.

The Client is also responsible for determining whether the venue has restrictions concerning:

• Delivery;

• Setup;

• Electricity;

• Generators;

• Water access;

• Outdoor equipment;

• Anchoring;

• Noise;

• Operating hours;

• Insurance requirements.

EZ Party Rentals is not responsible for venue policies that prevent or restrict the use of rented equipment.

14. PHOTO BOOTH & ELECTRONIC EQUIPMENT

For photo booths and other electronic rental equipment, the Client agrees to provide a safe and appropriate operating environment.

The Client is responsible for preventing intentional misuse, spills, physical damage, unauthorized movement, or tampering with electronic equipment.

EZ Party Rentals is not responsible for interruptions caused by venue power issues, internet outages, user error, environmental conditions, or circumstances outside our reasonable control.

15. EQUIPMENT MALFUNCTION

EZ Party Rentals makes reasonable efforts to ensure all rental equipment is clean, operational, and properly maintained.

If equipment becomes unavailable or malfunctions due to circumstances within EZ Party Rentals' control, EZ Party Rentals will make reasonable efforts to repair or replace the equipment with comparable equipment when possible.

EZ Party Rentals' liability for equipment that cannot be provided or used will generally be limited to the amount actually paid for the affected rental item, subject to applicable law and the terms of the individual rental agreement.

16. CLIENT REPRESENTATIONS

By booking with EZ Party Rentals, the Client represents that:

• They are authorized to enter into the rental agreement;

• The information provided to EZ Party Rentals is accurate;

• They will comply with these Terms of Service;

• They will comply with applicable laws and venue rules;

• They will ensure rental equipment is used responsibly and safely.

17. LIABILITY & RELEASE

To the fullest extent permitted by applicable law, the Client agrees that EZ Party Rentals is not responsible for injuries, damages, losses, delays, or other claims arising from the Client's misuse, unauthorized use, alteration, or improper operation of rental equipment.

The Client is responsible for supervising guests, children, participants, and other individuals using or interacting with rental equipment.

Nothing in these Terms is intended to waive or limit any rights or liability that cannot legally be waived or limited under applicable law.

18. INDEMNIFICATION

To the fullest extent permitted by law, the Client agrees to indemnify and hold harmless EZ Party Rentals, its owners, employees, contractors, and representatives from claims, damages, losses, liabilities, costs, and expenses arising from the Client's breach of these Terms, misuse of equipment, unauthorized use, or failure to comply with applicable laws or venue requirements.

19. PHOTOGRAPHS & MARKETING

Unless the Client provides written notice requesting otherwise, EZ Party Rentals may photograph rental setups and completed events for portfolio, website, social media, advertising, and promotional purposes.

EZ Party Rentals will make reasonable efforts to avoid publishing identifiable images of guests when the Client has specifically requested that guest photography not be used.

20. CHANGES TO RENTAL AGREEMENT

Any changes to the Client's rental order, equipment selection, event location, event date, rental period, or services must be approved by EZ Party Rentals.

Additional charges may apply to changes requested after the original booking.

The signed rental agreement and invoice may contain additional terms that apply specifically to the Client's reservation.

If there is a conflict between these Terms of Service and a signed rental agreement, the terms of the signed rental agreement will control to the extent permitted by law.

21. FORCE MAJEURE

EZ Party Rentals will not be liable for failure or delay in performing its obligations when such failure or delay results from circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, fire, power outages, government restrictions, transportation disruptions, venue closures, labor disruptions, or other unforeseen events.

EZ Party Rentals will make reasonable efforts to communicate with the Client and provide available alternatives when circumstances permit.

22. RIGHT TO REFUSE SERVICE

EZ Party Rentals reserves the right to refuse service or terminate a rental when necessary due to:

• Unsafe conditions;

• Abusive or threatening behavior;

• Illegal activity;

• Misuse of equipment;

• Property damage;

• Failure to comply with these Terms;

• Failure to make required payments;

• False or misleading information.

In such circumstances, the Client may remain responsible for applicable charges and damages.

23. GOVERNING LAW

These Terms of Service shall be governed by the laws of the state in which EZ Party Rentals is legally organized or operates, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be handled in accordance with applicable law and any dispute-resolution provisions contained in the applicable rental agreement.

24. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

25. ENTIRE AGREEMENT

These Terms of Service, together with the applicable rental agreement, invoice, booking confirmation, and any written policies provided by EZ Party Rentals, constitute the agreement between EZ Party Rentals and the Client regarding the applicable rental.

26. ACCEPTANCE OF TERMS

By submitting a booking request, making a payment, signing a rental agreement, or using rental equipment provided by EZ Party Rentals, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.

IMPORTANT PAYMENT POLICY

ALL DEPOSITS ARE NON-REFUNDABLE.

By submitting a deposit or booking payment, the Client acknowledges and agrees to EZ Party Rentals' non-refundable deposit policy, subject to applicable law.
